Teen sentenced for terroristic threats made against Halloween attraction in Sarpy County

OMAHA, Neb. (WOWT) - A teen who was charged with terroristic threats after making a post on social media threatening to “shoot up” a Sarpy County haunted house attraction was sentenced Monday.

18-year-old Marshall Fry was charged with terroristic threats, and had his bond set at $10 million when he made his first court appearance on Oct. 24.

On Monday, he was sentenced to three years in prison and 18 months of supervised release. He was given credit for 237 days.

A Sarpy County Sheriff’s Deputy was dispatched on Oct. 6 to Scary Acres after a comment was made on the attraction’s Instagram account saying “Finna shoot you guys up.”

The head of security at Scary Acres, a retired OPD gang unit detective, was concerned about the comment due to previous incidents.

An OPD investigator also looked into the account that made the comment, but the account was not following any local accounts or anything that would indicate the identity of the account’s owner.

A search warrant submitted to Meta led to the account being linked with accounts on Instagram that depict acts of violence.

The detective served a subpoena for the account’s IP address, and the owner of the address in question had a wife and three children, one of which was Fry, according to an affidavit.

Currently, Fry is on Juvenile Probation in Sarpy County, and his probation officer confirmed to the detective that the number linked to the Instagram account is the same one they used to contact Fry.

The detective said that because of the comment made by the account, Scary Acres had to pay for extra security and search every patron that entered the attraction.
