Bond set at $1 million for suspect in deadly crash

A judge has ordered the suspect in a deadly New Year's Day traffic accident held on $1 million bond.

Vismar Carmona-Martinez, 19, is charged with Motor Vehicle Homicide while Driving Under the Influence.

In court Wednesday, prosecutors said Carmona-Martinez had a Blood Alcohol Content of .240 - three times the legal limit, at the time of the crash.

The wreck happened just after midnight, January 1, on Highway 75 at the L Street exit.

Police say Carmona-Martinez was driving a Chevy Malibu north on Highway 75. Witnesses said he was traveling over the posted 60 mph speed limit. He slammed into the back end of a Chevy Spark driven by 67-year-old Ann Smock of Omaha. His car then crossed two northbound lanes on Highway 75 and hit a concrete barrier.

Smock was taken to the hospital in critical condition and died shortly after arrival.

Prosecutors asked for the high bond noting that Carmona-Martinez is in the country illegally.

Prosecutor Jim Masteller, with the Douglas County Attorney's Office, said, "This defendant is here illegally. He's a citizen of Mexico. We wanted to make sure we obtained a sufficient bond as we considered him a flight risk. He has really no local ties that would hold him here."

The judge agreed with the bond request. A preliminary hearing is scheduled February 5th.
