Woman Convicted of Social Security Fraud

A federal jury in Lincoln has convicted Marcella Scharton of three felony counts related to Social Security fraud. Count I charged Scharton and her husband, David W. Seevers, of stealing $115,010.40 in Social Security Disability Income payments to which they were not entitled.

Count II charged Scharton and Seevers with concealing and failing to disclose information to the Social Security Administration, with the intent to secure payments from the Social Security Administration, when no payment was otherwise authorized. Count III charged Scharton with making a false statement on a Social Security form that was used to determine Seevers’ eligibility to receive Social Security payments.

Seevers began to receive SSDI payments following removal of a malignant brain tumor in 2002, and then began working at Scharton’s Asphalt and Concrete paving firm. Neither Seevers nor Scharton notified the Social Security Administration of Seevers’ return to work. Scharton also falsely stated on Social Security reporting forms that Seevers had not worked since 2002.

Ms. Scharton’s sentencing has been scheduled to occur on November 18 before Richard G. Kopf, U.S. District Judge, in Lincoln. David Seevers previously pled guilty and has been sentenced.

The case was investigated by the Office of Inspector General - Social Security Administration.
