A man injured in a bar shooting will stand trial for being a felon in possession of a gun.
Trentelle Clifton was shot at a bar, near 30th and Spaulding, in December 2011. 39-year-old Robert Nash was killed in the shooting.
Trentelle Clifton appeared in a Douglas County courtroom Tuesday.
According to witnesses, Nash came into the bar and fired at Clifton first. Clifton allegedly returned fire, killing Nash.
Tuesday, prosecutors laid out just what happened inside the Spaulding Bar near North 30th and Spaulding Street. Two months ago Monday night, Robert Nash was shot and killed inside the Spaulding Bar.
Police say they found the 9mm gun, they believe, Clifton used in the shooting inside a trash can at the bar. Source say since Nash allegedly fired first, Clifton won't face murder charges.
No one has since been charged in Nash's death.
Tuesday, prosecutor's shed new light into events leading up to the shooting. From the beginning, the family of 39-year-old Robert Nash has told Channel 6 News, Clifton was the man who first killed Devon Nash and now the brother, Robert.
"Team Nash, we going to stick together, team Nash going to stick together, Trentelle know what it is, Trentelle couldn't even look me in my face, he couldn't even look me in the face but he kept a smile." Regina Nash, the sister of the two brothers, was inside the Spaulding Bar when the shooting occurred. "This is my brother, my first brother Devon, this Devon Nash this is the first one, then 106 days later we bury Robert Nash."
An Omaha homicide detective took the stand Tuesday and says a bartender who witnessed the shooting told said Clifton was already inside the bar when Robert Nash walked in and fired at Clifton.
Then bartender told the detective Clifton, now standing in the middle of the barroom, returned fire with a 9 mm handgun. When the smoke cleared -- both men were hit, Nash lay dead. The Nash family says this isn't the first time they and Clifton crossed paths.
Reeshard Parks, mother of both Devon and Robert says, "He (Clifton) needs to stand trial for the murder of my sons."
A source familiar with the case tells Channel Six News, Clifton will not face a murder charge because he fired in self-defense. Clifton, however, will go to trial on a felony weapons charge, offering a glimmer of hope to the Nash family.
"That's my first step to justice, that's what we wanted, that's what we've been waiting on and it's coming through," Nash said.
Clifton has not been charged with killing Robert Nash. That's because no DNA or fingerprints were found at the scene connecting Clifton to the murder.
However, Judge Craig McDermott did rule there was enough evidence to move forward with a trial on the weapons charge. A trial date has yet to be set.
The Nash family previously told Channel 6 News that they believe Clifton killed their other son, 40-year-old Devon Nash, in a separate shooting near 36th and Patrick in August 2011.
