In its opinion Friday, the state's high court said that Collins is entitled to a presumption that he was prejudiced by the jury's separation. The high court ordered the lower court to hold a hearing at which state prosecutors must prove Collins wasn't harmed by the error.

Collins was sentenced to life in prison for first-degree murder, plus 90 to 110 years for attempted murder and other counts, in the September 2008 shooting death of Timothy Thomas of Los Angeles
during what prosecutors called a botched drug deal.
