An effort to revive a $10.1 billion verdict against Philip Morris USA is headed back to a southwestern Illinois court now that the state Supreme Court has declined to get in the way.
Illinois' high court on Wednesday didn't upset an appellate court's February ruling that sends the case back to Madison County. A judge there sided with plaintiffs in a lawsuit over Philip Morris' marketing of "light" cigarettes. The state's high court later tossed that verdict.
The latest ruling clears the way for the plaintiffs to argue that a favorable 2008 U.S. Supreme Court decision may be applied to reinstate the case.
