Legal fight over lake lot.

The court cases involving Francis and Sandra Rayer and the Beaver Lake Association remain listed as active in Cass County District Court records. Each side filed civil lawsuits over a lakefront lot. The Beaver Lake Association wants the court to order the Rayers to remove items from Block C, a “utility lot” with a sewer lift station. In response, the Rayers, who own adjacent Lot 615A, brought an adverse possession claim against BLA.

In its lawsuit, BLA asks the court to order the Rayers to remove the encroachments.

The Rayers countered that they maintained it as one continuous property with their residence for 16 years and seek title to the property.

In a temporary injunction order in September in BLA vs. Rayer, Cass County District Court Judge Jeffrey Funke said the Rayers could have no contact with the lift station nor could any lawn sprinkler system water touch the lift station. Depositions are now being taken.

A progression hearing on the adverse possession case is set for March.
