In Nebraska, a kiss is still just a kiss – whether it is welcome or not. On Monday, State Senator Bill Avery withdrew his controversial bill that would have made a mouth-to-mouth kiss without permission in the category of second or third degree sexual assault.
LB 797 would have changed the definition of sexual contact to include kissing without consent. Avery introduced it after hearing concerns from a constituent who was attacked by a man who forced a kiss against her will.
Avery introduced the bill last Thursday. The same day he told Channel 6 News that he might withdraw it for several reasons. A county attorney did not think he could prosecute cases involving a kissing bandit. He also heard from many who thought LB 797 was a waste of time.
