Plea Agreement for jewel thief. A 21-year-old Omaha man will likely serve a sentence in the Nebraska Department of Corrections as the judge appears to agree with the sentencing recommendation in the plea agreement.
The Cassgram reports Damian Applegate pled guilty to a Class IV Felony theft count. Deputy Cass County Attorney Steve Sunde said Applegate assisted in the theft of a wedding ring from the home of his girlfriend’s parents in Plattsmouth this past May. He then pawned the ring in Omaha.
As part of the plea agreement, the prosecution and defense are jointly recommending a sentence of not less than one year and not more than one year in the Nebraska Department of Corrections. Cass County District Court Judge Randall Rehmeier was ready to proceed directly to sentencing after the plea was entered but there is still a question about restitution. Rehmeier gave the prosecution some time to figure out the restitution issue and set sentencing for December 18th.
Applegate is currently in custody at the Cass County Jail.
