The Nebraska Supreme Court is giving an Omaha couple another chance to make the case that they were unfairly ordered by their homeowner's association to shutter their home-based child care service.
Glen and Rhonda Wolf appealed after a Douglas County court found in favor of Farmington Woods Homeowners Association, which sued over the Wolfs' child care service. The association said the Wolfs violated covenants against conducting "business activities of any kind" out of the neighborhood's homes.
The Wolfs said the association allowed them to run the day care for 12 years and continues to allow others in the neighborhood to run businesses from their homes, including the association's president.
The Nebraska Supreme Court on Friday found that the Wolfs make what a jury might find to be a valid argument.
