Hair Stylists Promised Back Pay

A pay dispute has up to ten hair stylists frazzled over their final check. They quit in early December but claim the salon where they worked still owes them two weeks commission and wages. The salon owner contends the stylists didn't give adequate notice.

The stylists said the dispute erupted from a change in how they're paid, going from commission to chair rental. Stylist Sheila Berck said, "Even though you quit a job you are still owed money you earned." Ten stylists claim together they are owed about $12,000 in back pay. Jesus Villagomez who claims to be owed about $1,000 said, "I'm angry, that was supposed to be Christmas money, bill money and rent money." The sylists claim they should have received final checks days before Christmas.

The stylist worked for M Constantino Salon and Spa in West Omaha. Owner Sue Poore said the stylists left without warning and lack of two weeks notice crippled her ability to cut final pay checks.

The Nebraska State Labor Department has been involved in getting the back pay issue resolved. State Labor Law Specialist Rich Nelson provided the stylists and salon owner with a copy of a section of Nebraska Labor Law. "Once an employee is separated from the payroll, the unpaid wages constituting commissions shall become due on the next regular payday following the employer’s receipt of payment for the goods or services from the customer from which the commission was generated. The employer shall provide an employee with a periodic accounting of outstanding commissions until all commissions have been paid or the orders returned or canceled by the customer.” (Sec. 48-1230.01, NE Revised Statutes)

Salon owner Poore told Fact Finders checks have been shipped overnight to the state labor department which will distribute the checks to stylists yet this week.

Poore said she has been hiring new stylists and plans improvements for the M. Constantino Salon and Spa.

The stylists who quit moved on to another salon.
