Update: Deputy Pleads Guilty To DUI

The off-duty Douglas County Sheriff's Lieutenant who was stopped for DUI has pleaded guilty in the case.

Richard Lally was pulled over in January on the UNO campus. Since this is his first offense, he was sentenced to six months probation and his driver's license was revoked for 60 days.

Lally is in charge of security at the Civic Center, which houses several county offices, including Small Claims Court. According to Chief Deputy Marty Bilek, Lally has been disciplined; however, he will not be demoted because his job doesn't require driving.

An off-duty Douglas County Sheriff's Lieutenant is on administrative leave while the department looks into recent DUI charges.

According to police reports, University of Nebraska at Omaha security officers noticed a blue Chevy, eastbound, on University Drive around four o'clock Saturday morning. Officials reported the Chevy was weaving and driving on the wrong side of the road. Omaha police were called in to help.

When officers stopped the vehicle, driven by 46-year-old Richard Lally, Junior, they reported an odor of alcohol. Police reports indicate an initial blood alcohol level of 0.185. 0.08 is the legal limit for driving.

Lally was cited for driving under the influence -- a misdemeanor. He serves as head of the Douglas County Swat Team and was driving and unmarked county SUV when he was pulled over.

An internal investigation is underway to see if Lally will face discipline for the citation and SUV usage.

Here's the Douglas County policy regarding take-home vehicles: "The use of a county vehicle by an employee who is under the influence of alcohol or drugs is strictly forbidden. Any such vehicle use will be considered a violation of work rules, and may be grounds for disciplinary action up to and including discharge."

Lally has been with the sheriff's office for 15-years.
