Complaint Filed Against Douglas County Election Commissioner

Douglas County Election Commissioner Dave Phipps responds to an official complaint made against him.

Adam Morfeld is the Executive Director and Founder of the group, Nebraskans for Civic Reform. He filed the complaint with Nebraska's Secretary of State's Office.

Morfeld wasn't available for an interview on Tuesday; however, he stated in a press release that his group believes that hundreds, and potentially thousands of voters weren't able to vote during the General Election three weeks ago.

"The idea that hundreds, or thousands of people were turned away is just ridiculous," Phipps said.

The group organized, what they term, a non-partisian election observation program. They say their data showed wide-spread confusion among voters, which they blame on Phipps.

"We discovered that the Election Commissioner's precinct inspectors were actually denying provisional ballots to voters unless they had their voter identification number, which is in violation of the Help America Vote Act and federal law," Morfeld said.

Phipps says election workers are trained, but being only volunteers, they can make mistakes.

"I know of two people who were turned away for not having a voter I.D. number on Election Day," Phipps said. "When we found out about it, we corrected that information and made sure that it didn't happen again."

Phipps says he is now expecting a call from the Secretary of States Office, asking him questions. From there, he isn't sure what will happen; however, he assumes the complaint won't get a lot of traction.

Late Tuesday, the Nebraska Secretary of State’s office acknowledged it had received a complaint -- alleging that voters at two separate polling locations in Omaha were asked to provide their voter identification numbers in order to receive provisional ballots on Election Day.

This is the second complaint filed under the Help America Vote Act since it was implemented in Nebraska in 2002.

The complaint is being reviewed by John Gale’s office.
