Civil lawsuits now have trial dates set according to the Cassgram. Nicholas Sampson and Matthew Livers are suing Cass County, Douglas County, the Nebraska State Patrol and investigators, including former Douglas County CSI commander David Kofoed.

Livers and Sampson were held for months as the prime suspects in a double-murder (Wayne and Sharmon Stock) in Cass County in 2006, but were later released. Two other people confessed to the crime. Kofoed said he found physical evidence that tied Livers and Sampson to the killings but Kofoed was later found guilty of evidence tampering in the case and sentenced to 20 months.

Sampson and Livers say their constitutional rights were violated by the investigators. The suit seeks unspecified damages for civil rights violations and for lost wages, pain and suffering.

Sampson first filed a lawsuit in U.S. District in Omaha the fall of 2007; The Livers suit was filed in the spring of 2008.

If no settlement is reached beforehand, court records indicate the trials will begin November 14th.
