Guilty plea in burglary case. 26-year-old Brandon Franklin will be sentenced in Cass County District Court on January 17th on the Class III Felony conviction.
Franklin is already in state prison on criminal convictions from other counties. According to state corrections department reports, he has a projected release date of January 16th on sentences related to those convictions.
The Cassgram reports in Cass County, Franklin’s latest conviction stems from a burglary in November of 2010 northwest of Plattsmouth. Guns were taken from the house. A fire was set at the residence too. Deputy Cass County Attorney Steve Sunde said an accomplice, 25-year-old Jared Rye of Plattsmouth, would have testified against Franklin. (Rye was sentenced two months ago to consecutive 20-month to 5-year sentences on third-degree arson and attempted burglary convictions for his part in the incident.)
In a plea arrangement, Franklin pleaded guilty to the burglary count and the prosecution dismissed two felony arson counts and also a habitual criminal charge. The prosecution and defense will jointly recommend a sentence of 4 to 5 years.
Franklin was brought to Cass County for the plea hearing from the state corrections center in Tecumseh. There he is serving sentences for DUI (3rd, over .15 BAC), operating a motor vehicle to avoid arrest and theft by unlawful taking. The first two convictions were in Dodge County and the theft conviction was in Platte County.
Franklin had started serving those sentences in May of 2009 and was out on parole when he was arrested for the incident in Cass County one year ago. He was then remanded back to the state corrections center.
