Customers who hired a fencing contractor and paid him up front are now angry because never showed up to do the work. He didn't show up because he was in jail.

After paying TNT Fence $1,200, Dawn Spencer discovered why the owner never showed up to do the work.

"After checking records, I found out he was in jail," she said.

Matthew Taylor is in Sarpy County jail on a charge of having sex with an under-aged girl.

Dawn sued him in small claims court for a refund on her fence down payment.

She says, "I knew where to have him served. I know where he is but also know he's not making any money while in there so it's hard to recover $1,200."

Cassandra is another customer left without a fence after paying TNT half down. She trusted the contract which says TNT Fence is a member of the Better Business Bureau.

Cassandra says he told her, "'Go check us out we're on there.' Then when we did finally pull it up on the Better Business, he was on there -- but with complaints and bad news."

The Better Business Bureau kicked out TNT Fence six years ago after numerous complaints, so bureau president, Jim Hegarty, is surprised to see a recent contract with the company claiming to be a member.

"It's a false claim," he says. "And it's designed into deceiving consumers into thinking the company is reputable when it's not."

Cassandra paid TNT Fence $2,000 and doesn't believe she'll get her privacy fence. The company owner, if convicted of the sex charge, might be behind bars for a long time.

"That's $2,000 we'll never see again," she says.

Matthew Taylor's mother tells Six on Your Side that her son did not take customers' money while knowing he was going to jail. Because his bond is a half million dollars, she's not sure if her son can make bail and finish the fencing jobs.

I'm not sure what most of these respondents are talking about when they say "reputable companies don't ask for money up front." That is completely inaccurate. I am a small business owner and when I do a big job I require a small percentage down to cover initial expenses. It also covers me if and when the customer backs out for some reason. It shouldn't matter whether you put down money up front or not. Do business with reputable companies and you won't have to worry about it. An easy rule to follow, use referrals. Ask friends and family who they use. First hand experience is the best. By the way, I recently had a fence installed and yes, they asked for half down. We also ran into somw issues but all was worked out in the end. It's not fair to say "only crooked companies ask for money down."

I know Matt very well and have sent him business over the years and came to find out he has been screwing people for years now. About 2 years ago he did half of my mothers fence in till myself and another friend showed up to his door and then he finished it. But don't worry he will be in prison for a VERY long time.

Tom - there IS a way to warn people - it's called the BBB. The article says that "The Better Business Bureau kicked out TNT Fence six years ago after numerous complaints" - if NONE of these people checked it out FIRST, then part of the fault is with them. It sounds like TNT Fence is just out to make a quick buck and they COUNT on people NOT checking things out (that's why they list the BBB logo on their contract.) Though I have a certain amount of simpathy for anyone that gets swindled out of their hard-earned money, the sympathy stops when the details come out that the contractor was NOT verified BEFORE the money was given. So much info can be gotten on the internet - how long does it take to check a business out first? If the contractor can't WAIT for you to check them out, then you shouldn't deal with them anyway. The reputable companies will understand and probably EXPECT people to be cautious and sheck them out first. Sorry you lost money, maybe you learned a lesson instead.

If its a company you've never worked with before, check them out or ask around before you plunk down over $1000! Do your homework!! My guess is this company offered a very low rate and these people jumped on it.

I did have TNT install a fence a couple years ago and I do feel lucky that he did finish the job, but Matt was a total jerk. He was not very nice to his customers. I recently had Quality install a fence, they did ask for half upfront but they did finish the job and did a nice job at that. But from now on, no one will be getting any money from me upfront. These stories are becoming far more frequent.

There is a warning system out there to warn people before they hire a contractor. Its the BBB web site http://search.bbb.org/ Go there and search for the companys name it will tell you how long they have been a member and how many complaints they have had in the standard last 36 months. If they have had way to many then dont hire them.

I gave this same contractor $1700.00 down payment about a year and a half ago to do a fence. I was also swindled. I did not get my fence and was not successful on getting anything done legally to the contractor. I just wished there was a way to warn people of people like this. This is not the first time this contractor stole money frome people. I just wished there was a way to stop him.

My husband owns a company here in the metro, he said you would never ask for the money upfront. You have to be a man of your word, before anything else matters. He doesn't do the work, he doesn't get paid, it's that simple..Duh!!!

Actually, reputable companied usually ask for money up front. Sometimes about a third of the cost of the work to be done. Reutable companies no sooner want to be ripped off from the consumers than the consumers want to be ripped off from the companies they hire.

Jeff what do you mean you never give money up front? All of the major reputable companies in Omaha that Ive delt with for landscaping, lighting, new windows, etc. REQUIRED at least half up front. But over the yrs of dealing with the same company they have stopped asking for it.

Makes sense to me, Jeff. If a property owner doesn't pay the contractor, they can always file a lien against the property. It's not going anywhere, but a crooked contractor goes where the wind blows and so does your money if you pay up front.

I feel sorry for these individuals, however S&W does ask for a portion of the payment up front also. Scam artists are everywhere, it is so hard to trust anyone anymore....

I don't feel sorry for these people. They were just trying to save a buck. You NEVER give money up front. Any reputable company would never ask for money up front. At least the dozen companys that I have used have never asked for money up front. Always check out the company before you hire them. Common Sense......
