A new trial has been ordered in a case where parents of a 3-year-old boy sued Omaha's Children's Hospital and Medical Center for his death.
In ordering the new trial, the Nebraska Supreme Court also rejected a $900,000 judgment against the hospital.
In a ruling released Friday, the court said the trial court was wrong to prevent the hospital's expert from offering an opinion about what caused Corey Richardson's death in 2005. The court also ruled that Richardson's medical records should have been admitted at trial.
After his death, doctors determined Richardson died of an inflammation of his pancreas that wasn't diagnosed.
The boy's mother, Patricia Richardson, said the hospital should have admitted her son and should have given him intravenous fluids. The hospital argues IV fluids would not have prevented the toddler's death.
