Juror Recognizes Last Name

Mistrial declared in Cass county theft case.

The six-member jury in Cass County Court had already been seated and sworn in Wednesday when it was discovered one of the jurors had a previous association with one of the prosecution’s key witnesses.

The Cassgram reports such questions are asked during jury selection, but due to the juror’s unawareness of the witness’s last name the connection was not made at that time, said Cass County Attorney Nathan Cox.

Later in court, the witness recognized the situation and appropriately alerted court officials. Cox termed it “an honest mistake that can happen.”

The misdemeanor theft trial was moved to the August trial docket.
