Elkhorn Case Back Before High Court

Two former Elkhorn employees whose severance packages were upheld by the Nebraska Supreme Court after Omaha annexed the city are asking the court to grant them interest and compensation for attorney's fees.

Donald Eikmeier and Cheryl Eckerman say in their appeal of a 2009 Douglas County District Court ruling that they're due the money under the Nebraska Wage Payment and Collection Act.

Eikmeier was paid about $52,500 by Omaha after the high court
ruled the severance package built into his contract was valid.
Eckerman got almost $11,000.

But the city has denied their request to pay interest and some attorney's fees from the court fight, estimated at more than $22,000 and growing. A district judge upheld the city's decision.

Arguments are set for Tuesday.
