Todd Spangler, facing a felony manslaughter charge for his role in a fatal crash in June at West Shores Lake, waived his right to a preliminary hearing on Tuesday.
The state said Tuesday Spangler was intoxicated at the time and was driving the boat in a "reckless manner." Prosecutors said they have witnesses who will testify Spangler was driving recklessly.
His attorney, James Martin Davis, said the fact that Spangler had been drinking did not influence his driving on the water. Davis said Spangler was driving the boat like any boater would do who was pulling an inner tube.
Spangler was operating the boat while pulling his wife and her friend on June 21st. At one point, both women went flying off the inner tube and hit a dock.
Thirty-year-old Jennifer Dwyer was killed and Spangler's wife Kim was seriously injured.
Spangler said his wife is recovering and they are beginning the grieving process for her friend.
Investigators said his blood-alcohol level was twice the legal limit when the accident happened. The felony manslaughter charge could land him in jail for up to 20 years if convicted.
