Unusual Protection Order Request

Teammates on the basketball court find themselves on opposite sides in court.

16 year old Clare Tokheim has filed a petition asking a judge to grant a harassment protection order against Larry McIntyre, a teammate’s father.

In the affidavit requesting the order Tokheim’s mother Cari alleges McIntyre took postings from her daughter’s Facebook site to officials at Marian High School in Omaha.

Cari Tokheim claims McIntyre was trying to portray her daughter as a bully.

McIntyre would also videotape Marian games. The Tokheims want a judge to hear one of those game tapes claiming McIntyre’s commentary amounted to verbal harassment of their daughter.

The Tokeims attorney Randy Paragas says, “Verbal and visual harassment is the best way to characterize that. In terms of his antics in the stands when my client would have a bad pass or do a bad thing in the game.”

McIntyre’s attorney puts a different spin on the allegations. Tom Locher says, “There’s another side to the story that will be heard. We deny the statements.”

After four postponements Judge Thomas McQuade’s patience is being tested.
He set a hearing next week that looks more like a trial with eight witnesses including the Marian high principal and coach. The father's video tape commentary will be a key piece of evidence. The two players may also testify.

Both are expected to be teammates next year for their seniors season but next week they’ll be on opposing sides in court with their parents.

The Tokheim's attorney says a harassment order he's seeking would not prevent McIntyre from attending his daughter's games. But he's asking the judge to order McIntyre to not make public comments about the play of another player.
