Vacation Lawsuit Dismissed

A retired professor who sought more than $276,000 for unused vacation has lost his lawsuit against the University of Nebraska.

Allen Blezek sued the Board of Regents in Lancaster County District Court, saying he was paid for only 392 of the 4,392 hours of unused vacation time during his 32 years at UNL. He retired on Sept. 1, 2007.

NU had a "use it or lose it" vacation policy before fall 2006, when the Nebraska Supreme Court ruled that employers had to pay exiting workers for any unused vacation time.

District Judge Karen Flowers dismissed the case last week, saying he had been paid for the 392 hours of accumulated vacation as of Aug. 30, 2007.

She said he couldn't claim pay for vacation he had forfeited under the old NU policy.
