A lawsuit against the highest power could be considered by Nebraska's highest court. State Sen. Ernie Chambers of Omaha notified Douglas County District Court Thursday he intends to appeal the lower court's decision to strike down his lawsuit against God.

The appeal will be filed with the Nebraska Supreme Court.

Last month, a judge threw out the lawsuit because God wasn't served a legal notice. Chambers argues that since God is supposedly all-knowing, the Almighty would know about the lawsuit.

Chambers sought a permanent injunction against God last year, saying the Almighty has inspired fear and caused "widespread death, destruction and terrorization of millions."

Chambers is a self-declared atheist.
