    Former Husker charged in alleged road rage incident

    An ex-Husker will stand trial for second-degree assault. A preliminary hearing was held Wednesday for 29-year-old Willie Miller, accused of intentionally ramming the SUV of an off-duty Omaha Police Officer last month.

    Police and prosecutors are calling it an incident of road rage. Miller's attorney says it's more like negligent driving. He believes the authorities have gone too far.

    "The fact of the matter is that at the end of the day I think these are overcharged, I think these are traffic offenses and they have no business being in a criminal courtroom," said Miller attorney Beau Finley.

    When Officer Lacoma took the stand, he testified that while on the way to work, he witnessed Miller make a reckless lane change on the West Dodge Expressway, so Lacoma honked his horn.

    According to Officer Lacoma, he and Miller both got off the expressway at 132nd Street and were turning in opposite directions when Lacoma said Miller turned around and followed him south on 132nd Street.

    Finley said he hasn't seen any reports that verify that claim. "News to me, I don't know what lanes they were in."

    What everyone is certain of is what happened next. Miller's Suburban struck the back of Lacoma's car near 132nd and Pacific. The crash totaled Lacoma's vehicle.

    "May have been overcharged by the prosecutors or charged inappropriately," said Finley. "I think he's dealing with the situation where he's been charged with a crime and probably ought not have been charged with that crime."

    Lacoma has been with the traffic unit of the Omaha Police Department for 12 years. He told the court he estimates Miller's speed at the time of the crash at about 90 mph.

    Miller played for NU a decade ago. He is free on a $25,000 bond. A trial date has not been set.

    Chip on his shoulder is not even close to how he is.....try a fricken boulder. Karma really sucks huh Willie? Walking around like he's some kinda something cause he's an obese, ex-football player. Most have no clue who he is. Perhaps he'll get put in his place this time with the judge and or jury. It will all come out....the whole incident and all of you cop bashers will look like fools. Willie is a VIOLENT man who thinks he's intelligent. Not so much though.

    To Anonymous @ 5:28 PM...yes there are ordinances (which vary state to state and city to city) regarding "improper use of horn". I don't think in the case of the older woman in K.C., though, that it was fair, since she WAS trying to get the attention of someone (a daydreaming cop). I almost got involved in road rage yesterday in Benson because a car in front of me cut off a van that was directly in front of me, then once they were onto Maple in Benson they stopped in the middle of the road looking for someone...the van driver laid on their horn for a good 30 to 45 seconds and I thought "here we go" between the two drivers. The van driver could have possibly been ticketed for "improper use of horn", I don't know. The time to honk at the driver of the car was the minute they swerved in an attemnpt to change lanes into the van, I guess.

    I'm a large guy, but I don't have a chip on my shoulder like this Miller thug. If someone half my size flips me off, I just shrug with amusement and go on my way, I don't chase after them and ram my SUV into them or start pounding them.

    I used to live in Kansas city, and supposedly they have an ordinance against honking your horn in traffic. A few years ago, an elderly lady honked her horn at a police officer because he was sitting in traffice daydreaming, blocking traffic. The officer followed her to her house, tried to arrest her for"honking her horn". Well, its funny that up until that time no one had ever heard of the city ordinance. The lady was questioning the officer about the ordeal, he ended up using a taser on her and arrested her for resisting arrest for honking her horn. The lady was in her mid 60's. Many neighbors and others that were driving at the time that did not even know the lady, spoke on her behalf, said that she did nothing wrong. Still she was arrested and spent the night in jail and had to post a $500.00 fine, for honking her horn. I normally on the side of an officer but this was one where the officer went way out of control; but since he was a police officer, his word is law.

    I guess next time someone cuts me off, I'm just going to ram into them, and just expect to get a slap on the wrist. Come on, he totaled a vehicle, that doesn't happen from a love tap. This guy was out of control. Nuff said!

    Lacoma is part of the traffic unit and therefore does speed estimation and accident reconstruction. Speeds of a crash can me estimated, scientifically by the damage etc. Lacoma's car was totalled. This was just a preliminary hearing so all of the evidence was not presented. If it goes to trial I'm sure there will be testimony from both sides about speed estimates and such. It does an officer no good to lie on the witness stand as it would jeopardize their testimony for any future court proceeding for their entire career. Get a clue you few haters out there. Lacoma is a good cop and was the victim here. You could show me video of Lacoma flipping Miller off, which didn't happen, and that still would not justify the reaction of Miller. You aren't allowed to intentionally ram your car into someone elses car even at 20 mph let alone 90.

    Chris - the last paragraph states that "He told the court he estimates Miller's speed at the time of the crash at about 90 mph." That would lead me to believe that Miller's speed was about 90 mph at the time of the crash. But hey - what do I know - I wasn't there.

    Amazing...90 mph??? I would hate to get stoppped by Lacoma with his sense of estimates. 90 mph would be a serious accident and any thoughts of fighting would be replaced by thoughts of wiping blood and trying to breathe. Lacoma with the traffic unit for 12 years...incredible. Can't way until he spikes for retirement in 8 years or so.

    If it wasn't an off duty POLICE OFFICER Willie would not be in court. You should not get in an accident with an EXPERT witness that is not shaken up in the accident.

    No, Chris, the story states the officer estimated Miller's speed AT THE TIME OF THE CRASH (which we can all take to mean at the time of IMPACT) at 90 mph. None of us may be expert accident reconstructors but I stand by my belief that a crash at 90 mph is going to seriously injure or even kill someone, and would certainly involve more than just those two vehicles at a busy intersection at a high-traffic time of day.

    To LLR...yeah, 90 mph is reasonable. If you think about physics (which by the way plays a huge role in accident reconstruction), then yeah, 90 is reasonable. Now...if the officers vehicle was sitting motionless, then I would agree, 90 would be an over estimation. However, the officers vehicle was in motion, going the same direction as the suspects vehicle. So, imagine if you will, the officer is maybe driving at 40 or 50 mph, and the suspect rammed him at 90, then there pretty much is just a 40 to 50 mph impact. That would have totalled his car, but not caused life threatening injuries. And futher more, this suspect didn't just strike the officer, but fought the officer. His own attorney even is able to recognize his guilt. Notice he isn't even argueing that the incident didn't happen as it is reported. He's simply going for the angle, and the hope, that a judge or jury will buy his angle that it wasn't that big a deal. Yet another anti-cop person who makes assumptions without thinkin.

    it's totally obvious he didn't hit him at 90 mph and the officer is exaggerating. it happened a month ago... if willie was really going 90, then i think this man would be a lot more hurt than he is. i think this is ridiculous.

    Oh COME ON...90 MPH?! Someone should be dead, or at least very seriously injured. And certainly more than 2 cars would be involved...this was rush hour at 132nd & Pacific. I've been down that stretch of road at that time of day, and you can't convince me they were the only two cars involved. Not supporting Willie, here, but NINETY?

    To the anonymous goofball who called Lacoma "Barney Fife"....actually, by law, it is ok to honk at other drivers who are driving careless. So, Lacoma was in the right. You on the other hand, are making assumptions about that officer. Oh, because you know the law better than everyone else? Or because you think you can do a better job?     Overcharged, lucky he didn't kill the Officer and the driver in the car in front of the Officer. Put yourself in the Officer's shoes. I would just love being hit from behind at any speed, but 90 mph, geeze good luck with that one. It's more about Willy being a bully. Oh no, this guy honked at me, therefore, I'll chase him down and show him whoes boss. Ya just picked the wrong car this time.

    I don't care if he was going after the guy or not... if you are going 90 mph and you crash into someone, you should certainly be charged with felony assault with a deadly weapon in my oppinion. A vehicle going 90 mph is just as deadly as a gun if you ask me... He is just lucky noone was killed or seriously injured. Lock him up and let him think about it for awhile. There is no reason to drive like an idiot and risk everyone elses lives on the road. Ridiculous.

    absurd comments by attorney. Didnt Miller turn around and catch up with the off duty officer a mile away. And hit him at 90 miles an hour. seems like more than a traffice accident and should appropriately be charged with a felony
