13 Year Old Defendant Won't Spend 4th Behind Bars

A 13 year old boy accused of sexual assault on two younger children won’t spend the 4th of July behind bars. His attorney Steve Lefler filed a motion to block a detention hearing. That won’t be heard until next week.

The Douglas County Attorney’s office requested the 13 year old be placed in custody pending further court action. A 12 year old boy accused of the same act was sent back to the youth center yesterday.

However due to the separation of the cases in juvenile court Judge Wadie Thomas ruled the motion by the defense can’t be heard this week. The 13 year old is required to stay with his parents and stay away from younger children.

The five year old girl and her now seven year old brother were sexually assaulted two weeks ago in a northwest Omaha park.

Lefler said his client’s parents are good people and the boy is remorseful. However the victim’s father fears for other children in the neighborhood and said the 13 year old defendant is free for now because of a technicality.
