The 18-year-old mother who abandoned her newborn baby in a hospital restroom on Labor Day was in court Wednesday, seeking custody of the infant.
A judge ordered Evan Joshua Sanwick be placed with his maternal grandmother.
The judge also granted supervised visitation rights to mom Montana Sanwick, who was present accompanied by her mother and stepfather.
Nothing has been settled yet, but it does look as if little Evan will be reunited with his mother, father and older sister.
First Montana has to go through a series of court ordered rehabilitations, essentially to prove that she will be a good mother.
Montana left Evan in a Bergan Mercy Hospital restroom on the afternoon of September 3rd.
"She knows she made a lapse in judgment and she wants the baby back and she wants to be a mom for the second time," says Montana’s attorney, Ryan Hoffman.
Montana has been working toward that end. She visits Evan almost every day, spending around six hours with him per day. Outside the courtroom, Evan's foster mother said she believes Montana is a wonderful mother.
Montana later spoke with reporters and said she was confused and already had a daughter and didn't want to disappoint everyone again.
Montana's daughter turns two on Thursday. Montana says of the day she dropped Evan at the hospital, she "stayed in the bathroom with him 20 to 25 minutes, didn't want to leave him."
The very next morning, Montana, her mother, and stepfather hired Hoffman and started the process of reunification.
"They're elated, that was their plan and everybody worked together, they jumped through the necessary hoops and now Evan will be home today,” says Hoffman. “They're going to get a car seat and go pick him up."
Montana says she and her babies' father have been together four years and after Evan is returned she does believe they will get married, but first she has to get through the court process.
Her next hearing is October 16th.
