Last time I checked the defense attorny had the job of keeping people out of jail. Not cops.

The ONLY reason the "mother" taught her kid about the miranda rights was to save her own butt. Now if anything ever happens to this little girl (like gets lost, kidnapped, hurt) she will be to scared to talk to the police. Selfish move on the mom, shame her

If you drive through small towns the local cops will pull you over if you go as much as 1 mph over the posted limit. Sometimes the posted limit changes within 35 yards and you hardly have time to slow down, unless you slam on your brakes.

At least she was teaching her kids something... And something useful as well, there are far too many laws in this day and age. Nobody should ever talk to a police officer without a lawyer. That is just plain, good advice.

A lot of people have to deal the police even though they haven't done anything wrong. As Wyatt pointed out, he's been pulled over for no reason other than DWB (Driving While Black).

You are so so wrong. Those days did exist for those of us who were willing to make them exist. I had parents who supported my teachers before believing any lie I thought I could get away with. I had parents who taught me that if I did nothing to attract the police they would not target me. And guess what? They don't. I have never had or felt the need to use my Miranda Rights.

Lets take a quick look at Miranda: The key is that statements made "Can be used against you.". What exactly is a 4 year old girl going to say that would implicate her in a criminal case? And, if she did somehow become the focus of an investigation, that is when Miranda would be applied. A witness or victim (a child being abused) could easily be confused by a self protecting family member who drills into them that Miranda is necessary any time an officer asks questions. That is NOT the courts intention with Miranda. The intent is to protect against self incrimination via coercion, promises and or threats. If you're being investigated for a crime then invoke your rights, but if you're teaching any child this to keep your self out of trouble, you should not be around kids.
