Sorry this happened, but sledding has been around for some time now. So what, we will be banned from using parks or other city areas for sledding? Lawyers, ruin it for everyone. No one should get money for their stupid mistake!

Trees where here long before the city was.

It makes sense that the city would plant trees in a public park. It does not make sense that a citizen would endanger his children by allowing them to sled alone down the hills at Memorial Park. At 5 and 9, they were not capable of steering well enough to avoid trees. The father was totally negligent and lacking common sense.

I think the family should have not received any money. The PARENT in the situtation should have noticed the trees and found another place for their kids to sled. People need to take responsibility for what they choose to allow their children to do.

If this was a designated sledding hill the city bears some responsibility to be sure its safe. Lawyers will gobble up most of the money anyway. What a life changing event for the whole family. How sad.

I have to say, I wondered why this money was awarded in the first place. It is very sad that this happened, but it is not the city,s fault. The trees were there before this parent chose to let the girls sled down the hill. Take responsibilty for your bad decision.

I agree with a lot of you that life's not fair and the parents bare responsibilty. The judge did hold him partially liable. But the city has some liability too and was made aware of these trees being a danger 8 months prior and were advised to remove them. 2 weeks prior to this accident another sledder hit those trees and broke her jaw which the city was also aware of. As for "retiring off" this, the girl's lifetime medical bills will be more than double the settlement...sad situation and nobody's wins in this.

Really? the city planted trees in a park, that seems normal to me.

Haven't we established that trees in a city are dangerous? They fall down and destroy property or they kill and injure people. They cause power outages and when the burn the cause pollution. If I want to see a tree I'll go to the woods. They don't belong in a city.

I think I'll go biking in an Omaha park this summer, ride into a tree, and retire in comfort!

Um Anonymous, maybe the city planted those trees at the bottom of that hill because they didn't want that hill used for sledding anymore. WHATEVER the reason, it doesn't matter. People need to take responsibility for their actions. DUH!!!!!

I am very sad for the family. There loss is great and there burden is great now with the other daughter... That being said any hill that I have been to in omaha has a sled at your own risk sign posted... This should not be the citys responsibility. The parents were negligent and should not have let there kids sled on that hill. Im sorry any tree large enough to cause this damage would be large enough to seeeee! The fault is of the parents not the citys! I say reverse the judgements. $2.5 mill????? really?

Opps, I fell down and skinned my knew at the park, suing the city. Opps my kid was at the ball park at the city and got hit with a bat on the ball field, suing the city. People have to be responsible for themselves and their behavior. The city parks are not patrolled to keep idiots from harming themselves. Just like a city swimming pool is not a public babysitting service either. But plenty of parents come dump their kids at the pool for the day too.

Although I feel bad for the girls. Seriously? I agree with Jamie.....DUMB!
Posted by: Ben on Apr 4, 2012 at 12:30 PM

Very said story for the girls. This makes me sick. $2.5 million dollars to this family and another $10 million of tax payers money to tie up the court system. Take responsibility for your actions. This is not the cities fault.
