Awful story. Prayers for the family & the deceased. Was the driver even ticketed? They crossed the center line & killed someone 10 weeks ago. What's the reason on the insurance company not paying? So many unanswered questions.

Please someone refer a GOOD LAWYER to this family. I know them and they are truly wonderful people. They need all the help they can get in order to see that the other driver pays for what she did. The hospital bills are insurmountable for this family. I think a crossing the center line ticket is a bit lenient. I also feel bad for the man who followed her for miles and had to witness this horrific. Kudos to him for acting responsibly even if law enforcement refuses to do the same.

Because the other driver has not been charged with a crime (ticket) as of yet, does not absolve responsibility. It sounds more like the policy was not in effect. Re-read the part where they thought she gave them current policy information.

So many wrongs with this case. Insurance? Please report the name of the Insurance Company refusing to pay and their reasoning. I would like to change if they are my carrier. Why, after having a witness call 911 repeatedly, was this driver not located? Was the driver immediately ticketed for crossing the center line, then receiving add'l charges pending the investigation/lab testing? Prescription drugs also indicate no driving, so, if they do/did, she knowingly got behind that wheel, taking a chance with innocent peoples lives. My biggest prayers and condolences for the daughter and father.

Not sure why the other woman cannot be named. She was involved in a crash where somebody died. What does not being charged with a crime have to do with it? The names of people involved in crashes are routinely disclosed. Sounds like she may be somebody that the media is trying to protect.

It seems like justice for innocent victims is always the last thing the courts want to deal with. Looking out for criminals' "rights" is the number one priority.

I believe that all insurance policies have disclaimers relieving them of liability if the insurer vehicle is operated illegally, i.e., under the influence, by a driver with no valid license, etc.

I am very sorry to hear about this family's loss. It's hard enough to be grieving then to be dealing with problems like this. A witness was following from Missouri Valley to Omaha and contacted 911 twice and no law enforcement responds in that timeframe? Isn't that at least 45 minutes or longer? To me, a "general broadcast for law enforcement to be on the lookout" sounds like the witness was not being taken seriously enough to specifically get an officer on it right away.

Please stay strong. The Logan, IA community is behind you 110%. You are a very strong girl and I hope justice is served. If you are drunk you are charged within a month but, take as many prescription drugs as you want and you walk free. There is something wrong with the justice system. What is the deal with the insurance company, maybe the insurance is not valid.

Because insurance companies are evil monopolies who are only out to take every penny you have, then royally screw you when you need them the most. Looks like this family needs to lawyer up asap.

Okay...so WHAT THE HECK IS GOING ON with law enforcement and the seeming inability to respond to 911 calls from motorists reporting impaired drivers? Someone followed this woman from Omaha to Missouri Valley and in all that time law enforcement couldn't find her?
When the four motorcyclists were killed on I-29 a couple summers back, people were calling 911 to report Andrew Schlictimeyer's erratic driving 45 MINUTES before the crash and law enforcement couldn't seem to find him even though the people calling in were giving precise locations.
This family needs a good lawyer, fast... first, to deal with the woman's insurance company (you have to go after these companies, they aren't going to just show up with money for you)... AND to look into a civil suit against the law enforcement agencies. "We followed procedures"... isn't good enough, and someone is dead because of it.
Five people are dead in two years because of law enforcement's inability to locate and stop impaired drivers, even when they know their location. At what point do we decide "the procedures" might not be good enough?
