Prison for man who assaulted a Cass County jailer.
23-year-old Michael S. Uptain of Plattsmouth had pled guilty to 3rd degree assault of a peace officer , strangulation and attempted escape, earlier this year. He had also pled guilty to a felony drug possession count as part of a plea agreement.
The Cassgram reports that Cass County District Court Judge Randall Rehmeier sentenced Uptain to two to five years on the assault conviction, 20 months to five years on the strangulation count and one year to two years on the possession conviction. Those sentences in the Nebraska Department of Corrections are to be served concurrently.
Uptain was also given one to two years on the escape conviction. That sentence is to be served consecutive to the other sentences.
Uptain was given credit for jail time served since October.
Rehmeier said the sentenced amounts to Uptain serving 18 months before being eligible for parole and three and a-half years before being able to "jam out" of prison.
Uptain was first arrested on October 30th for stealing methadone tablets from a Plattsmouth man.
The day after Uptain’s arrest, Uptain grabbed a female jail deputy in an escape attempt. Chief Deputy Cass County Attorney Colin Palm said Uptain overpowered her, put her in a "choke hold" and then grabbed some keys and pressed them against her head. The jail deputy feared for her life, said Palm. Another jail deputy responded to a radio call for help and they both subdued Uptain.
