A 95-year-old nursing home resident has filed a claim against the Iowa Department of Human Services and sued the home, saying she was sexually assaulted last year by a convicted sex offender who had been placed there.
The woman says the state didn't ensure 83-year-old William Cubbage would be properly supervised in the Pomeroy Care Center. Her lawsuit against the center says it didn't protect her.
Cubbage is awaiting court action that could return him to the Civil Commitment Unit for Sex Offenders.
Department spokesman Roger Munns says a 2010 evaluation of Cubbage says he couldn't be compelled to remain in the unit. Munns says the department informed the home of Cubbage's record.
