Update On Serious Domestic Violence Case

Prelim waived by a 42-year-old Plattsmouth man who will be arraigned on felony charges in Cass County District Court on April 21st. James D. Johnson a/k/a Darrel A. Dubry waived his right to a preliminary hearing in county court.

Johnson faces five felonies.

The Cassgram lists four counts that stem from his alleged involvement in an incident on January 15th: two counts of false imprisonment in the first degree, Class 3A Felonies, strangulation, a Class 4 Felony, and operating a motor vehicle to avoid arrest, a Class 4 Felony.

The arrest warrant affidavit alleges Johnson abducted and assaulted his pregnant 42-year-old girlfriend. She then jumped from a moving car to get away from him. Her 3-year-old son was in the vehicle at the time. Police were notified and the affidavit says Johnson’s Chrysler Sebring sped around a Plattsmouth Police cruiser that attempted to stop him on Wiles Road and the car then went northbound on Highway 75 at a high rate of speed. There was concern for the child’s safety. The car later was observed going southbound. Johnson returned the child to his residence and then drove away, said a witness account.

An arrest warrant was issued.

There is also another felony count of operating a vehicle to avoid arrest. That charge stems from his arrest by a Nebraska State Patrol trooper on January 28th.

Bond for the charges connected to the January 15th incident was set at $250,000. Bond in the January 28th case was set at $100,000.

Johnson remains in custody at the Cass County Jail.
