Teen Gets Probation For Park Sex Assault Of 5-Year-Old

One of two teenage boys received his punishment Thursday on criminal complaints of first-degree sexual assault against a 5-year-old girl and her 6-year-old brother at an Omaha park last year.

The parents of the victims first spoke to Channel 6 News last June about how the teens forced their little girl to perform sex acts and her brother was forced to go along.

The sentencing went as expected. The offender was put on probation. The victims’ family said they knew that going in and wanted to attend the trial to make sure the teens never abuse anyone again.

The victims’ mother said enough people know who the teens are and what they've done so people are watching them. What the now-14 year-old boy did was take advantage of a 5-year-old girl, sexually assaulting her in a park across the street from her home last summer. The girl later testified against the boys in juvenile court.

As part of his sentence, the 14-year-old will have to attend Lutheran Family Services' sex offender treatment program as an outpatient. Vickie Peyton is the program’s coordinator. “We do not treat them as adult sex offenders. We believe that they're children misguided, that there’s reasons that have bought them to this place where they would act out on a child.”

The teen must also wear a tracking device and perform 50 hours of community service. His attorney, Steve Lefler, thinks too much is being made of the case.

“Because the victims’ family has decided to make this their reason for living, you guys (the media) are here, the public knows about this. The reason why we have a juvenile court system is to protect kids because we recognize kids make stupid mistakes.”

The other boy, who was 12 at the time of the assault, will be sentenced next week.
