State Senator Calls For Refund On Wrongful Wheel Tax Payments

Nebraska State Senator Beau McCoy is asking the city of Omaha to refund wheel tax payments made by Douglas County residents who he says were wrongfully charged the tax.

“I am disappointed that the City of Omaha decided not to follow the law and is knowingly taxing Douglas County residents outside the Extraterritorial Zoning Jurisdiction (ETJ),” said Sen. McCoy. “I want to make sure that every affected taxpayer receives the refund they deserve for 2011 and 2012.”

According to McCoy, in 2011, the Nebraska Legislature passed LB 81 in response to the City of Omaha enacting an ordinance to collect the wheel tax from non-residents. LB 81 also ends the wheel tax within the ETJ on December 31, 2012.

Sen. McCoy became aware that the City of Omaha continues to impose the wheel tax on citizens outside the ETJ when he was contacted by a constituent earlier this year. Sen. McCoy has been attempting to work with the City of Omaha on a resolution, but to date the city has not responded to his letter sent on July 19th of this year requesting to be notified of how they plan to refund those unfairly taxed.

Sen. McCoy represents Legislative District 39 which includes most of western Douglas County, Valley, Waterloo and western Omaha.
