Repeat drunk driver sentenced.
45-year-old Joseph J. Abbott of Neola, Iowa had earlier pled guilty to third offense drunk driving, a Class W Misdemeanor, and to refusing a chemical test, second offense, a Class I Misdemeanor.
On Monday, Cass County District Court Judge Jeffrey Funke sentenced Abbott to one year on each count with the sentences to be served concurrently in the Cass County Jail. Abbott’s license was revoked for 15 years too.
The Cassgram reports the pleas were part of an agreement in which two felonies—one for drunk driving fifth offense—were amended to the misdemeanors and three other lesser counts were dropped.
Calls from motorists about a driver swerving on Highway 75 were received on May 10th of this year. Law enforcement responded and found Abbott in his car in the parking lot of the Plattsmouth Eagles Club. Deputy Cass County Attorney Rick Fedde said the police report said Abbott was then sleeping and the engine was running. Abbott refused to take a field sobriety test and refused a chemical test, said Fedde.
