Plea Deal In Animal Shootings

18 year old agrees to restitution. Nine of 11 criminal charges were dismissed against Jeffrey Ivey of Omaha; he pled guilty to one felony and one misdemeanor.

The Cassgram reports Ivey was charged in the shootings of five cows and one horse in the rural area south of Murray. The shootings occurred last December. It was on December 30th that a passerby saw a blue pickup on the rock roads and observed the occupants firing guns out the window. Aware of the previous cattle shootings, the citizen notified the sheriff’s department and the pickup containing Ivey and a 15-year-old male was stopped east of Murray. A .22 caliber rifle, an AK-47 and a 12-gauge shotgun were seized from the pickup.

Chief Deputy Cass County Attorney Colin Palm said both individuals admitted to their involvement although each admitted to only one animal shooting and blamed the other for the other five.

Three cows died; two cows and the horse survived.

Ivey stands convicted of criminal mischief, a Class IV Felony, and of cruel mistreatment of an animal, a Class I Misdemeanor. Among the charges Ivey had faced were three counts of use of a weapon to commit a felony, Class I-C Felonies.

Palm said Ivey is to pay $2,586 in restitution as will the 15-year-old whose case is in juvenile court.

The prosecution and defense agreed on recommending probation with the term likely to be at least two years, according to discussions the attorneys had with the judge during the hearing. Sentencing is May 9th.

Ivey had not posted bond since his arrest. Bond was reduced to $3500 (10% applicable) from $50,000. Public defender Julie Bear said if Ivey can post the $350, he will then report to Sarpy County where another case is pending. If bond is posted there, Cass County District Judge Randall Rehmeier said Ivey must reside with his parents, follow a curfew and not possess any firearms.
