A plea agreement was hammered out Tuesday in the kidnapping and sexual assault case against 17-year-old Kreighton Elwood but the details are still under wraps.
Elwood, the son of the Treynor, Iowa Community Schools Superintendent, reached the deal with the Pottawattamie County Attorney’s Office Tuesday afternoon.
The teenager had been scheduled for arraignment at 1:30 p.m. The prosecutor and Elwood’s defense attorney, Joe Hrvol, negotiated for three-and-a-half hours before finally submitting the deal to the court about five minutes before the courthouse closed for the day.
County Attorney Matt Wilber told Channel Six News’ Chase Moffitt that he couldn’t immediately reveal the details of the agreement but the prosecutor said the deal would be, "a global resolution to include all four of the girls involved in the case.” In exchange, Elwood removed his motion to move all charges to juvenile court.
Elwood was initially charged as an adult, facing a felony kidnapping charge and two counts of 3rd Degree Sexual Assault. A conviction on that kidnapping charge could carry a maximum penalty of life in prison. These charges stem from accusations of two girls. Elwood also faces charges from two other alleged victims but those cases were deferred to juvenile court.
In November 2012, when Elwood was a student at Treynor High School, he allegedly picked up a classmate at her house and brought her out to a nearby cornfield. It was in that cornfield that she attempted to get out of Elwood’s truck, but he’s accused of forcing her to stay, taking her cell phone and hiding it.
Court documents obtained by Channel 6 News describe how the victim says Elwood forcibly removed all her clothes except for her underwear. She said he then began kissing and touching her before trying to force her hands down his pants. The girl said at that point she heard someone come out of a nearby house and she said Elwood put his hand over her mouth and pushed her down in the seat.
A similar incident, with a different Treynor classmate, is alleged to have taken place only a month later during a district snow day. Court documents describe Kreighton allegedly trapping that girl in his car. She told investigators he tried to, "literally rip (her clothes) off" and tried to force sex on her. The girl told investigators she repeatedly told Elwood, "no."
