A pet owner accused of abuse says witnesses got it all wrong.

Last night Fact Finders showed you Zeke. A four month old Australian Kelpie confiscated by the Nebraska Humane Society. Witnesses claim they saw the puppy punched and thrown in the courtyard of a northwest Omaha apartment complex.

But Zeke's owner Matthew Osterhaus says it was dark and says he thinks witnesses didn't see what really happened. Osterhaus says, "I smacked him on the butt, I never hit a dog in the face and I grabbed him by the scruff and said hey knock it off. It’s a big understanding I just want my dog back."

But the Humane Society has enough evidence to cite Osterhaus for animal cruelty. He'll says he'll fight the charge in court and ask a judge to return Zeke.
