Pedestrian Struck By Jeep

A man was taken to the hospital in serious condition after being hit by a Jeep Sunday morning.

Twenty-nine-year-old Marvin Hernandez of Schuyler, Nebraska was trying to cross L Street at 33rd just after midnight when he was hit by a Jeep Cherokee. The impact shattered the right-hand side of the Jeep's windshield and left Hernandez with a head injury and fluid in his lungs. He is expected to survive.

Police say the driver was not at fault as Hernandez was not crossing the street in a crosswalk. "There is no apparent alcohol on the part of the driver, he just tried to avoid the pedestrian and unfortunately struck him," said Omaha Police Sgt. Jason Menning.

Although the driver was not at fault for the accident, he should not have been behind the wheel in the first place. Forty-nine-year-old Michael Shada of Omaha was ticketed for driving during suspension and no proof of insurance.
