A 23-year-old Iowa man has won a new trial in the fatal shooting of another man in a Des Moines parking lot.
The Iowa Court of Appeals said Wednesday that Matthew Grady was
improperly interrogated.
Grady was convicted in June 2010 of first-degree murder for
shooting 37-year-old Stephen Scott in August 2009.
Scott was shot through the back while behind the wheel of his car. Prosecutors said Grady admitted being in Scott's car about 10 minutes before the shooting. Defense attorneys said Grady left the
car before the shooting.
The Appeals Court says Grady invoked his right to remain silent
during an interrogation, but officers continued for three more
hours. The judges say the answers officers obtained were used to
help convict Grady.
