The Nebraska Supreme Court has upheld removal of a man's parental rights over his son because he had twice abused the boy's half brother.

In a decision released Friday, the court says the father is an unfit parent.

The father is identified only as Randal R. His son, Ryder, was born in November 2008 to Randal and his girlfriend, Natasha J. She already had a son, Crue, who was born in May 2005.

In 2008, Randal was convicted of attempted child abuse of Crue and was given probation. Randal was charged again in late 2009 and convicted for the attempted abuse of Crue. Randal was sentenced to
20 months to 48 months.

A Lincoln County court subsequently stripped Randal of his parental rights over Ryder, citing Crue's abuse.

Randal appealed.
