More on the felony charge against former Cedar Creek Village Clerk first reported by WOWT6 Fact Finders.
69-year-old Mary C. Terry of Cedar Creek, is charged with Theft by Deception, value over $1,500, a Class 3 Felony. Terry, who claims she is innocent, turned herself in to authorities yesterday, went through the booking process and was released.
She is accused of misusing village funds over a three year period from April 2011 to April 2014 but the alleged misuse may date back further.
The Cassgram reports that from the arrest warrant affidavit signed by Investigator Randy Wilkins of the Cass County Sheriff’s Department: “Documentation indicates in excess of $79,000 was misappropriated between Jan 2009 and Jan 2014 however spot checks prior to Jan 2009 show the overall theft could well be in excess of $100,000. Statute of limitations restrict criminal charges to 3 years which would consist of Apr 2011 through Apr 2014 for a total of $35,356 in misappropriated funds.”
The affidavit said in 2013 a temporary assistant clerk who is a CPA noticed irregularities in the issuance of checks compared to the treasurer’s report. The village attorney was notified and an independent audit was performed. Canceled checks, wage and tax reports, payroll records, the village treasurer’s records and the village expense distribution journal were among the items investigators also inspected.
In an email sent to Cassgram last night, Terry said, “Every year the auditor inspected all the financial records, ledger where everything I was paid was itemized, canceled checks, bank statements, and found (nothing) wrong. He also never told me I was doing anything wrong.”
She will appear in county court later this month.
