A mistrial has been declared in the prosecution of murder suspect Avery Tyler. He's accused of killing Delayno Wright.
The trial began on Thursday. It came to an abrupt halt on Friday due to alleged juror misconduct.
Douglas County Attorney Don Kleine said jurors made statements that caused the judge to raise concerns. Opinions were reportedly expressed that were deemed inappropriate.
Kleine says they plan to re-try the case with a new jury but he said this was, "very frustrating."
No new trial date has been set.
Delayno Wright was killed in September 2012. He was shot to death outside of the Halo Bar near 175th and West Center Road.
The victim's mother, Tracey Wright, told WOWT 6 News Friday's development was extremely frustrating but added that she would rather there be a re-trial and start from scratch than to have it open to appeals later.
