New paperwork reveals why police believe a man is guilty of sexually assaulting a child. It details what officers seized in a search of his home.
Benjamin Oates, 57, is accused of 1st Degree Sexual Assault of a Child.
In April, a judge will decide if there's enough evidence to make him stand trial on that charge.
A police affidavit WOWT 6 News obtained Wednesday shows the alleged crime first came to light in mid-February.
In an interview at Project Harmony, a 9-year-old girl said Oates had assaulted her multiple times. She told a forensic interviewer Oates had pulled a gun on her, threatening to kill her. The 9-year-old girl also says Oates told her he wanted to "get married with her and have a baby."
After searching the home of the suspect, police found a photograph of the victim, a revolver, girls' underwear and four cellphones. Everything except the photo was in his dresser.
Oates is currently in jail on a $100,000 bond.
If convicted, he faces 20 years to life behind bars.
