Wrongful death lawsuit filed in Cass County District Court.
44-year-old Keith L. Turner of Murray was declared deceased at the scene of a three-vehicle collision about 1:30pm on September 4th of last year. Turner’s vehicle was struck from behind and pushed across the centerline into the path of a rock truck with pup, said law enforcement.
The Cassgram reports the lawsuit names the driver of the car that struck Turner’s vehicle from the rear, 23-year-old Chase Lautenbach of Omaha, and Wessels Trucking of Weeping Water, the owner of the truck, as defendants. The plaintiff is Pamela Turner Murungi, the representative of Turner’s estate and the mother of his three children ages 17, 14 and 10.
The suit seeks general damages, judgment for conscious pain and suffering sustained by Keith Turner, and special damages.
The suit, which asks for a jury trial, claims Lautenbach failed to maintain a proper lookout, operated his vehicle at speed greater than was reasonable and prudent for the conditions, and failed to maintain reasonable control of his vehicle.
Seat belts were in use by all parties, said the sheriff’s office report.
No criminal charges have been filed in the fatal crash by the county attorney’s office at this point. Cass County Attorney Nathan Cox said his office received final reports a few days ago and is now reviewing those.
