A Sarpy County district judge has ruled that property taxes levied by a board that oversees Omaha area schools are unconstitutional.
A ruling issued Friday by District Judge William Zastera says the Learning Community levy amounts to a state-authorized tax in
violation of the Nebraska constitution.
The Learning Community was created by the Legislature and signed
into law in 2006. It oversees common property tax levies among 11
school districts in Douglas and Sarpy counties. It works to
de-emphasize district borders and put greater focus on achievement
Zastera's ruling comes in a lawsuit filed by the Sarpy County Farm Bureau and eight residents. They had claimed the "taxation scheme" seeks to direct money to favored school districts at the expense of taxpayers in other districts.
