Omaha police have made an arrest in the shooting that killed a 23-year-old man Saturday morning.
But late Monday afternoon, the Douglas County Attorney's Office decided not to file criminal homicide charges against forty-four-year-old Dwayne Blackson.
Blackson was originally charged with shooting and killing Brown.
Blackson will face charges of being a prohibited person with a weapon and possession of a stolen firearm along with a misdemeanor warrant for failure to appear in court in a separate case.
Officers in the area of 45th and Grand heard gunshots at 2:40 a.m. and found Brown at 45th and Larimore suffering from a gunshot wound. He was taken to the Nebraska Medical Center where he died.
“I have a granddaughter, she’s a year old and the shooting was so close I thought they were shooting at my house and they could have been and my granddaughter was sleeping right here,” said Rochelle Starks. “I may leave today and I’m getting ready to leave, so I’d just rather be safe than sorry."
