A federal court has dismissed a lawsuit against Gage County officials brought by a man who was falsely accused of raping a woman.
Elliot Hawkins, of Wymore, sued Gage County and several sheriffs’ investigators over his 2011 arrest. The lawsuit sought an unspecified amount for lost earnings, damage to his reputation and emotional distress, among other things.
His arrest came after Jennifer Valenta, also of Wilber, told authorities she was raped by four men, including Hawkins. Investigators later determined her injuries from the alleged attack were self-inflicted. She pleaded no contest to evidence tampering, false reporting and attempted prostitution and was sentenced earlier this year to 32 to 60 months in prison.
Last week, U.S. Magistrate Judge Cheryl Zwart dismissed the lawsuit, saying the defendants have immunity from liability.
