Two years after his release a convicted sex offender is back in jail, accused of assaulting a 5-year-old girl.
Omaha police took 41-year-old Charles Hardymartin into custody Saturday night. Hardymartin is on Nebraska's sex offender registry. He was convicted of sexually assaulting a child four years ago.
“My brother needs help, he really does,” says Bryan Boeck of his stepbrother. Court documents show that in 2009, Hardymartin was sentenced to serve four to five years for sexual assault of a child, but ended up serving two-and-a-half years. He was released early for good behavior.
Boeck says Hardymartin recently came to him for help. “He needs mental help, he needs to get put in the hospital where he can get treatment."
Hardymartin is also facing sex offender registry violation charges. According to the Nebraska Sex Offender Registry, Hardymartin is listed as living at the Siena/Francis House in Omaha, but when Channel 6 News checked, the Siena/Francis House said it has no record of him living there or at any of their shelters.
Boeck said he didn't want to talk about the latest accusation. "I am not going to say that against my brother, I love my brother, I don't like what he done, but the facts will come out and he is going to have to pay for what he has done."
