Plea entered from man accused of theft from the Plattsmouth Eagles Club. The Cassgram reports 64-year-old James L. Mayabb of Plattsmouth pled guilty to theft by unlawful taking, a Class III Felony. That was the original charge filed against Mayabb last September. In return for the plea, the prosecution will join the defense in recommending probation at sentencing. Deputy Cass County Attorney Steve Sunde said it will be a recommendation for five years probation that will include restitution payments of $100 monthly during the five years.
Sunde said that won’t cover the full amount Mayabb stole from F.O.E. #365 but $100 a month is all that Mayabb can afford to pay.
According to the arrest warrant affidavit, it was during an audit in the transfer of a trusteeship at the Eagles club that it was discovered there were missing funds. Sunde said $10,369 was missing from pickle and petty cash accounts between June 1st of 2011 and September 5th of 2012. The affidavit indicated Mayabb cooperated during the investigation. Sunde said Mayabb admitted to investigators he took somewhere around $10,000 that he used for food, drinking and gambling. Sunde said the money was all spent.
Mayabb had turned himself in and remains free on $2,500 bond. Sentencing was set for March 25th.
